3. Payment Terms

• All payments are due as stated on the invoice.
• Setup fees are non-refundable.
• Monthly retainers auto-renew unless canceled in writing 7 days before renewal.
• Failure to pay may result in suspension of services.

4. No Guarantees

Marketing results vary by client and niche. We make no guarantees of sales, income, or performance outcomes.

5. Limitation of Liability

Under no circumstances shall Go Harder Marketing, its owners, affiliates, or contractors be liable for:

• Loss of profits
• Business interruption
• Data loss
• Any indirect, incidental, or consequential damages

Your sole remedy is limited to the amount you paid us for services.

6. Indemnification

You agree to defend, indemnify, and hold harmless Go Harder Marketing, its officers, employees, and affiliates from any claims, liabilities, or expenses arising from your use of our services or breach of these Terms.

7. Dispute Resolution

All disputes will be resolved exclusively through binding arbitration in Newport News, Virginia, under the rules of the American Arbitration Association (AAA).
No class actions. No court lawsuits. Each party bears its own legal fees.

8. Intellectual Property

All materials, templates, workflows, and systems developed by Go Harder Marketing remain our intellectual property unless stated otherwise in writing.
You are granted a limited license to use deliverables for your business only.

9. Refund Policy

Due to the digital nature of our work, all sales are final.
Refunds may only be issued at our discretion for duplicate payments or billing errors.

10. Termination

We reserve the right to terminate or refuse service to anyone for any reason at any time, with or without notice.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.
